According to the Toy Quality Control Rules issued by the Department for Promotion of Industry and Internal Trade, Ministry of Commerce, 2020, toy safety comes under the purview of BIS. Hence, Indian toy manufacturers are required to obtain BIS certification before placing toys in the market. In India, to issue BIS certification for toys , the Bureau of Indian Standards classifies toys into 2 categories:
  1. Non-electric toys: As the name suggests, these toys are not electrically powered such as teethers, rattles, puzzles, wooden toys, soft toys, etc. However, their physical and mechanical properties make them eligible for BIS registration for non-electronic toys in India. The standard implementation is IS 9873 (Part 1): 2019.
  2. Electric toys: These toys are electrically powered such as remote control battery operated toys. BIS certification for electronic toys in India will be as per applicable standard IS 15644:2006. Hence, the toys that come under this BIS registration for electric toys are electrically powered and can perform only one function.

Requirements for BIS registration for toys
  1. As per Schedule I of Schedule II of the BIS (Conformity Assessment) Rules, 2018, toy manufacturers operating across multiple locations will have to apply for a license to use the ISI mark separately for each production unit. This requirement applies whether the manufacturer is an importer or operates domestically.
  2. In case a toy manufacturer is not carrying out manufacturing and is only engaged in marketing and distribution activities, the Rules will not be applicable to that particular business activity. As per Scheme I of Appendix II to the BIS (Conformity Assessment) Rules, 2018, BIS certification for toys will be granted only to manufacturers themselves and not to those engaged only in marketing and distribution.
  3. Manufacturers of Electrical and Non-Electrical Toys have to apply for BIS certification separately for each type.
